The penalty is usually a percentage of your weekly income, up to a maximum of £1,000 (and £2,500 if you were driving on a motorway).

And the rules still apply for anyone just 1mph over the speed limit.

According to the AA, it’s unlikely you would ever be penalised for driving at 31mph in a 30mph zone – but it is still illegal.

In the instance of a penalty, you would most likely be offered a fixed penalty notice.

Although drivers who ignore this could find themselves in court.

Experts have previously told how the zero-tolerance 1mph crackdown is unfair as speedometers and speed cameras are inaccurate by around 2mph.

But in the eyes of the law, you’re liable for a speeding fine as soon as you exceed the limit.

Anyone caught going marginally over for the first time is generally urged to take a speed awareness course.

The road laws you need to know

Repeat offenders, however, will be slapped with a £100 fine and three points on their licence.

Those who drive substantially faster face higher fines and could lose their licence.

Guidance from the National Police Chiefs’ Council (NPCC) does recommend giving drivers a so-called ‘10% plus 2’ leeway, to help cops use their ‘discretion’.

However, this is only a recommendation and not the law.

Most speed cameras have to be manually set to trigger at a speed and it is unconfirmed whether they are in fact set 10% above the limit.

AA guidance states: “When you are caught speeding by a mobile camera, it is up to the police officer’s discretion to penalise you if you are over the speed limit in any way, they can choose to take the NPCC’s guidance, but do not have to, because – as stated above – 1 mile an hour over is still breaking the law.”
