Held eligible for All India quota, State govt to consider disabled student’s claim for MBBS admission – Times of India

AHMEDABAD: The state government submitted before the Gujarat high court on Friday that it will consider the claim of a student with spastic cerebral palsi for admission in undergraduate medical course in the state quota because she has been considered eligible for admission under the All India medical quota.
The case involves Khushi Vihol, who is having locomotor disability in her right hand. She has been found with 50% disability by a medical board in Mumbai and with 47% disability by a medical board at Ahmedabad Civil Hospital. The Mumbai board has certified her to be eligible for medical studies under people with disability quota according to the National Medical Commission rules. The state medical board, however, has considered her ineligible to pursue medical courses, and an appellate body has approved this stand.
However, Vihol has been found fit and eligible to pursue medical studies by the All India Institute of Medical Sciences (AIIMS) board for the All India medical quota. She has been allotted a seat in MBBS in Jamnagar medical college under the All India quota. She approached the HC through advocate K K Shah contending that is she has been found eligible and fit to study medicine in the All India quota under 5% reservation for people with disability (Gen-PwD), there should be no reason for not considering her claim for a seat in the state’s quota in MBBS under the same category.
The HC issued a notice to the state government over this petition on October 19. When the hearing took place on Friday, government pleader Manisha Shah submitted that Vihol’s case may be considered as a standalone case at this juncture. She also submitted that without prejudice to contentions raised in the student’s petition and in “peculiar facts and circumstances” because she has been considered eligible for All India medical quota under the reserved category, notwithstanding the negative certificate issued by the state medical board and approved by the appellate authority, the state government would still consider her claim under Gen-PwD quota in the ongoing admission process in the state’s quota. The government will inform the HC about its decision.
The HC has posted further hearing on November 10, when it expects the government to make a statement in this regard.
