HC Chief Justice for use of knowledge and experience in mediation – Times of India
RAIPUR: Chhattisgarh High Court Chief Justice Arup Kumar Goswami said on Monday that in the process of mediation, the mediator should use his knowledge, experience and training in resolving the cases considering all the aspects. The Chief Justice was inaugurating the 40 Hours Mediation Training Programme for judicial officers and advocates, organised by Chhattisgarh State Legal Services Authority, in Bilaspur on Monday
Keeping in view the increasing number of cases in the courts, a mechanism of mediation has been developed for the settlement of cases through mediation. The trained mediators analyse and understand the disputes between the parties and make efforts to resolve the cases through mutual understanding. That’s why it is necessary to give proper training to the mediator and it is only through training that the mediator is taught how to mediate between the two parties so that they can understand the matter well and solve it easily, said the Chief Justice who is also the Chief Patron of SLSA.
The Chief Justice further highlighted that the dispute between a husband and wife reached from the lower court to the Supreme Court, when the matter was pending in the Supreme Court, it was referred for mediation and the case was settled there through mediation.
Justice Goutam Bhaduri, Judge, Chhattisgarh High Court and Executive Chairman, SLSA said that at present the number of cases in the courts is increasing, because of which the pressure on the courts is commonly prevalent. Today world communities are developing various technologies, and due to this controversies are also increasing. Mediation centres are already operating at all levels, but the number of cases is not resolved as it should be, that is why this mediation training also becomes necessary so that the maximum number of cases are resolved through mediation, he said. This training programme will enable them, with tools and techniques as to how it can be done effectively between the parties.
Justice Sanjay Agrawal of Chhattisgarh high court and Chairman of the High Court of Mediation Committee said that such a system should be prepared for the disposal of pending cases between the parties, in which the parties can easily reach an agreement.
The first mediation training program was organized in the year 2015. After which very good results were seen. After the implementation of mediation, the number of cases started decreasing due to the settlement of cases through mediation, he said.
As many as five additional district judges (ADJs) and 47 advocates from across the state, for the first time, will undergo the five-day training programme which will be conducted by two senior trainers from Delhi and four potential trainers from Jharkhand and Uttar Pradesh respectively.
These mediators will work in their respective districts and dispose of compoundable cases. Elaborating on the mediation, he said that suppose a party wants to settle the case outside court after filing it then he or she will be referred to the mediation centres.
