Contempt plea by diving champion over denial of MBBS seat under sports quota – Karnataka HC orders notice officials – Times of India

BENGALURU: The Karnataka high court on Thursday ordered notice to Ramya S, Executive Director, Karnataka Examination Authority( KEA) and K.Srinivas, Commissioner, Youth Empowerment and Sports in connection with a contempt petition filed by Aditi Dinesh Rao, a national level diving champion.
A vacation division bench headed by Justice Mohammed Nawaz has posted the matter to next week for further communication consideration.
Aditi, an aspirant for MBBS seat under the sports quota, has claimed that the officials named in the contempt petition have failed to comply with the direction issued by the court on December 13, 2022 and hence appropriate action should be taken against them.
MP Srikanth, counsel for Aditi brought to the notice of the court that a division bench of the high court had specifically directed Department of Youth Services and Sports to re-do the ranking list inter se between petitioner and three others regarding their eligibility for admission to Under Graduate Medical Professional courses under the sports quota and submit the same to the KEA.
He added that the last date for completion of admission exercise is December 31 and the respondents have not acted upon the direction issued by the division bench.
It was also pointed out that there was direction to the KEA that it should ensure admission to the candidates based on their ranking vis-a-vis the revised ranking list to be furnished by Department of Youth Services and Sports.
Aditi, who had joined BDS course under protest, had challenged the admission granted to Sathwik Shivanand, SR Prathima and Khushi M Hombal( all chess players) under the sports quota.
She had alleged that the authorities altered the rank list relying upon the opinion that chess is an international game, the authorities had placed the other three her, even without affording an opportunity of hearing.
Partly allowing Aditi”s petition, the division bench had pointed out that a reading of the eligibility criteria specified under sports quota makes it very clear that candidates who represented the country in the international events/championships should have secured or if medals/cups they have participated in the national level championship representing Karnataka State, they should have secured medals/cups in such events.
The bench also noted that Aditi had secured 4 gold, 3 silver and 1 bronze medal in the national diving championship conducted by Swimming
Federation of India, whereas there is no material on record to show that the other three chess players have secured any medal or cup in any events organized by the All India Chess Federation or the School Games.
