Alice Evans ‘seeking custody of children’ as husband files for restraining order

Alice Evans is reportedly seeking custody of her and Ioan Gruffudd’s children amid a bitter divorce battle.

The Christmas Card actress, 53, has seemingly filed court documents seeking both physical and legal custody of their children Ella and Elsie, aged 12 and eight.

It comes after her estranged husband Ioan, 48, filed for a restraining order against her earlier this week.

In court documents seen by People, the Vampire Diaries star is seeking custody of their daughters while asking that visitation rights be granted to Ioan.

The outlet states that Alice is citing ‘irreconcilable differences’ as to the reason for their divorce.

She is also reportedly asking for spousal support from Ioan, her attorney fees to be paid by him, and the termination of the court’s ability to award spousal support to him.

The court has also reportedly been asked to determine who should be awarded the rights to their formerly-shared home in Los Angeles.

Earlier this week Ioan filed a restraining order against Alice, including over 100 documents showing messages from Alice accusing him of drug use, threatening to ‘call every tabloid in the UK’ and hurling insults at him and girlfriend Bianca Wallace.

In his court filing, he also claimed Alice verbally threatened to tell the media he had abused her and she would ‘do to me what Amber Heard did to Johnny Depp’.

Ian claimed Alice threatened to tell the media that he ‘had abused her and our daughters… call the police on me if I did not comply with her demands… tell people I am a drug addict and put me in prison’.

Screenshots of Alice’s messages show her repeatedly threatening to call the police, and goading him to ‘do it’ when she learned he was considering a restraining order.

While most of Alice’s messages went unanswered, images show Ioan responding sporadically in a formal manner where he requested she stop contacting him and described it as ‘harassment and abuse’.

Alice herself has rejected all the claims in the restraining order application and says she believes he is filing ‘as a ploy to gain some sort of advantage over me in our divorce proceedings.

‘As Petitioner has not seen our children for over eight months, I believe he is trying to set some type of record that I am a horrible mother,’ she said.

The pair were married for 13 years when Ioan filed for divorce in March 2021.

Lawyers for Alice and Ioan are due in court on March 11 for a hearing on the application.
