The Chattisgarh High Court discharged a 37 year old man in a rape case citing that he was married to the survivor and it doesn’t account for sexual assault. On August 23, Justice NK Chandravanshi delivered the judgment in a criminal revision plea filed by the man and his two family members, seeking to quash the rape charges against him.
As per the reports, the survivor was married to the man and within months was harassed for dowry. The women later lodged a case against him for marital rape but the HC acquitted him of the charge, stating “Counsel for the applicants submits that the complainant and the applicant No. 1 (man) are legally wedded wife and husband, therefore, none of the ingredients to constitute the offence punishable under Sections 376 and 377 of the IPC are spelt out against him, because, in India, marital rape is not recognised and the same is not an offence in view of Exception II of Section 375 of the IPC.”
Following the judgment, Taapsee Pannu and Sona Mohaptra expressed their disbelief at the verdict. Taapsee said, “Bas ab yahi sunna baaki tha,” while Sona tweeted, “The sickness I feel reading this #India, is beyond anything I can write here.”
